Please read these Terms before registering for, purchasing or using anything from The Mindful Movement Club. By creating an account, buying a membership, using the members' area or receiving coaching, you agree to them.
1. Who we are
The Mindful Movement Club provides online fitness, exercise, nutrition, wellbeing and lifestyle coaching.
"The Mindful Movement Club", "we", "us" and "our" means Mischa Kluyver, a sole trader trading as The Mindful Movement Club, of 6 Westbourne Place, Farnham, Surrey, GU9 8EF.
We are not VAT registered, so no VAT is added to our prices.
"Coach" means Mischa Kluyver, together with any suitably qualified coach we authorise to deliver part of the Services.
"Member", "you" and "your" means the person buying or using the Services.

We normally reply Monday to Friday, 9:00am to 6:00pm.
We will contact you using the email address and telephone number on your account. Please keep them up to date.
Marketing emails are separate from essential emails about your membership, payments, account security and coaching. You can unsubscribe from marketing at any time without affecting the rest.
3. The Services
Depending on the membership you buy, the Services may include:
- access to the online members' area;
- monthly exercise programmes and workouts;
- exercise demonstrations, videos and educational material;
- personalised exercise recommendations;
- progress and session tracking;
- habit tracking;
- the Food & Fuel nutrition-awareness tool;
- online check-ins and coaching support;
- live or recorded sessions;
- nutrition education and general guidance;
- lifestyle, habit, sleep and wellbeing guidance;
- the members' community; and
- anything else described for your membership.
What is included in yours is shown before you buy and in your confirmation. Different memberships include different levels of access and individual coaching.
4. You must be 18 or over
Membership through this website is for adults. Registration is refused if the date of birth given is under 18, and that is enforced on our server, not just in your browser.
If you are under 18, please email hello@mindfulmovementclub.com. Any arrangement would be made directly with your parent or guardian, with their consent, and outside the standard online membership.
5. Joining: what happens, in order
- You create an account with an email address and a password.
- You give your contact details, date of birth, emergency contact, and choose one of the memberships.
- You complete the PAR-Q health screening.
- If you answered "no" to every PAR-Q question, you are taken to GoCardless to make your first payment and set up your Direct Debit. Your application then goes to Mischa.
- If you answered "yes" to any PAR-Q question, no payment is taken and nothing is set up at GoCardless. Your application goes to Mischa first. If she approves it, you are then invited to pay.
- Mischa approves or declines. Your membership begins only when she approves it and your account is activated.
Paying does not by itself make you a Member. Until your application is approved, no monthly Direct Debit is created.
You must answer the PAR-Q honestly and as fully as you reasonably can.
We may ask you to get clearance from your GP or another suitably qualified healthcare professional before taking part, where your PAR-Q or anything else you tell us suggests that would be sensible.
We may decline an application where we reasonably consider the Services are unsuitable for you, fall outside the Coach's professional scope, or present an unacceptable health or safety risk. If we decline, no monthly membership is created, your Direct Debit is cancelled, and any first payment already collected is refunded in full. Where the PAR-Q was flagged, the email explaining our decision will suggest you speak to a doctor before applying again.
6. Telling us when things change
Your health can change after you complete the PAR-Q. You agree to tell the Coach promptly about anything material, including a significant:
- illness; injury; medical diagnosis; change of medication;
- pregnancy or postnatal condition; operation or medical procedure;
- allergy or food intolerance; or
- other physical or psychological condition relevant to your programme.
We may recommend that you pause or adapt your programme, or get medical clearance, before continuing.
7. Exercise carries risk
Exercise carries an inherent risk of injury.
You are responsible for exercising within your own capabilities, following the instructions given, and stopping if an activity causes unusual pain, dizziness, faintness, severe breathlessness, chest pain or any other concerning symptom. If symptoms suggest you need medical attention, stop and get it.
Before each session, make sure that:
- you have enough space to perform the activity safely;
- the floor and surrounding area are suitable;
- your equipment is suitable, correctly assembled and in good order;
- children, pets, furniture and other hazards are out of the way; and
- you follow the safety instructions supplied with any equipment.
Do not deliberately exceed a prescribed intensity, weight, duration or progression.
8. Nutrition guidance
Our nutrition guidance supports general fitness, wellbeing and healthy habits. It is not medical nutrition therapy and is not a substitute for advice from a doctor or a registered dietitian.
We do not diagnose, treat or claim to cure any disease or medical condition through nutrition, and we do not prescribe medication. Supplements, if mentioned at all, are discussed for general education only.
If you have a medical condition affected by diet, significant allergies or intolerances, are pregnant or breastfeeding, have a current or previous eating disorder, or have any other condition needing specialist dietary management, please get appropriate professional advice.
You must tell us about allergies and intolerances relevant to nutrition coaching. You remain responsible for checking packaging, ingredients and allergen information before eating anything — manufacturers change recipes without telling us.
Food & Fuel is a nutrition-awareness tool, not a calorie counter or a diagnostic tool. Where you send a photograph or a description of a meal, it is passed to an AI service to name the foods — see the Privacy Notice, section 7. Its suggestions are a starting point for you to correct, and are sometimes wrong.
9. We are not a medical service
The Mindful Movement Club is a fitness, nutrition and wellbeing coaching service. It is not an emergency service and does not replace your GP, hospital, physiotherapist, registered dietitian, psychologist or any other healthcare professional. Nothing we say is a medical diagnosis.
If you think you have a medical emergency, call 999 or NHS 111 — do not contact us and wait.
10. Results vary
Fitness, strength, weight, body composition, health and wellbeing results vary substantially between individuals, and depend on consistency, nutrition, sleep, lifestyle, health, medication, genetics and how closely you follow the programme.
We do not guarantee weight loss, fat loss, muscle gain, a particular body shape, a specific strength or fitness result, improvement in a medical condition, or results within a particular period.
Testimonials, photographs and examples on our website show individual experiences and are not a promise that you will achieve the same.
11. Your membership is personal to you
You must not share your account, password, training programme, meal guidance, videos, downloads or any members-only content with anyone else.
Access begins once your application is approved, any required health screening is complete, the initial payment has been taken and your account is activated.
What you can reach is determined by the membership you bought. Buying one membership does not give you access to content reserved for another.
12. Prices and payment
The price of each membership is shown clearly before you buy. Prices on the website are the current prices; the amount shown to you at the point of joining is the amount you are agreeing to.
Payments are handled by GoCardless Ltd, authorised by the Financial Conduct Authority. We never see or hold your bank details.
Unless your membership says otherwise:
- you authorise the payment arrangements when you join;
- your first payment is taken at that point by instant bank payment, and a Direct Debit is set up at the same time;
- nothing further is collected until Mischa approves your application;
- your first monthly Direct Debit is collected approximately one calendar month after your first payment; and
- monthly payments then continue until the membership is cancelled.
Where a month has no matching day — joining on the 31st, for example — the monthly payment falls on the last day of that month instead.
The exact collection date can move by a day or two around weekends, bank holidays and banking processing times.
Your Direct Debit is protected by the Direct Debit Guarantee, which GoCardless will send you when your Direct Debit is set up.
Offers. From time to time a membership may be offered with one or more months free. If you join on an offer, no first payment is taken and your monthly payments begin after the free period. The offer you joined on stays with you even if the offer later ends or changes.
13. If a payment fails
If a payment fails we may contact you and ask GoCardless to try again.
We may temporarily suspend access to paid Services while a payment remains outstanding. We will give you a reasonable opportunity to put it right before ending your membership permanently, except in cases of fraud or serious misuse.
14. Your 14-day right to change your mind
Because you buy online, you normally have a statutory right to cancel within 14 days of entering into the contract, under the Consumer Contracts Regulations 2013.
Some memberships include both coaching services and immediate access to digital content, so two rules apply:
- Coaching services. If you ask us to start during the 14 days and then cancel within them, you pay a proportionate amount for what was already provided.
- Digital content. Where you have expressly asked for digital content to be made available immediately and acknowledged that you lose the right to cancel it, that part can no longer be cancelled once supply begins.
To cancel, email hello@mindfulmovementclub.com. You do not have to give a reason. Nothing in these Terms removes any statutory cancellation or refund right you have.
15. Cancelling afterwards
Unless your programme states a minimum term before you buy, an ongoing monthly membership can be cancelled at any time.
Cancel using the facility in your account, or by emailing us. Once cancelled:
- no further monthly payment is collected after the effective cancellation date;
- you can keep using what you have already paid for until the end of that paid period; and
- access to members-only content ends when that period expires.
Cancelling does not normally refund part of a period already provided, unless the law requires it or we agree.
We will never make cancelling harder than joining.
You can also cancel a Direct Debit directly with your bank. Please tell us as well, so that we can close your membership tidily.
16. Fixed-term programmes
Some programmes are sold for a minimum term. Where that applies, the minimum term, total price, instalment arrangement and cancellation conditions are shown prominently before you buy, and that programme description and your confirmation form part of your contract. Nothing in a fixed-term arrangement limits statutory rights that cannot legally be excluded.
17. Changing prices
We may change the price of an ongoing membership. We will tell you in advance before an increase affects your payments, and you can cancel before it applies. A price change never retrospectively alters a period you have already paid for.
18. Changing the Services
We may make reasonable changes to improve a programme, update content, improve security or functionality, comply with the law, reflect current practice, or change a technology supplier.
We will not intentionally make a significant detrimental change to a paid Service without reasonable notice. If we materially reduce the main features of something you have paid for, we will offer an appropriate remedy, which may include cancelling.
19. Availability
We aim to keep the site reasonably available, but cannot guarantee uninterrupted access. Interruptions can happen through maintenance, hosting or internet failures, software updates, security incidents or matters outside our reasonable control. We will restore access as promptly as we reasonably can.
20. Account security
Keep your password confidential and do not knowingly let anyone else use your account. If you think your account has been accessed without permission, change your password and tell us promptly.
We strongly recommend turning on two-step sign-in in your account settings.
21. The community
The members' community is visible only to signed-in members. Other members see your first name only, your profile picture, your bio, and what you post — never your surname, contact details, health information or training records.
Please treat other members respectfully. You must not use the Services to:
- harass, threaten or bully anyone;
- promote dangerous exercise or extreme dietary behaviour;
- encourage eating-disordered behaviour or deliberate self-harm;
- publish discriminatory, hateful, obscene or unlawful material;
- spam or promote unrelated commercial services;
- distribute malware;
- impersonate anyone;
- infringe anyone's intellectual property; or
- try to reach another Member's information.
Posts are checked automatically before they appear. Every post and comment is passed through an automated check looking for the things listed above. If it is unsure, your post is held and Mischa reads it herself before releasing it. Nothing is deleted by the machine. If you think something was held wrongly, email us and a person will look. This is explained in the Privacy Notice, sections 6 and 7.
We may remove content and may suspend or end accounts for serious or repeated breaches.
22. Our content
Exercise programmes, videos, photographs, graphics, written guidance, training resources, branding and website material created or licensed by us are protected by intellectual property law.
Your membership gives you a personal, limited, non-exclusive, non-transferable right to use those materials for your own private purposes. You must not reproduce, sell, distribute, publish, commercially exploit or pass members-only material to anyone else without our written permission.
23. Your content
You keep ownership of the photographs, videos, messages, documents and other original content you give us.
You give us permission to store, display and process that material only as far as reasonably necessary to provide and administer the Services, meet our legal obligations and run your account.
Progress photographs and testimonials. We will not use identifiable progress photographs, transformation photographs, testimonials or similar personal material for public advertising or marketing merely because you are a Member. If we would like to, we will ask you separately. Saying no will never affect the coaching you receive.
24. Privacy and health information
Coaching requires us to handle personal information, including information about your health.
Our Privacy Notice — at www.mindfulmovementclub.com/privacy.php — explains exactly what we collect, why, our lawful basis, how long we keep it, who it is shared with and what you can ask us to do. Please read it; it is written to be read, not skimmed.
Where specific or explicit consent is needed, we ask for it separately.
25. Third parties we rely on
We use: GoCardless for payments and Direct Debits; Fasthosts for hosting and email; Anthropic for the AI features described in the Privacy Notice; Microsoft OneDrive for backups; and YouTube and Vimeo for embedded videos.
Where you deal with a third-party service directly — GoCardless, for example — that provider has its own terms and privacy information.
We are not responsible for independent websites merely because we link to them. This does not affect any responsibility we have for third parties acting on our behalf.
26. Our responsibility to you
We will provide the Services with reasonable care and skill.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for fraudulent misrepresentation.
We are responsible for losses that are a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was made.
Our Services are supplied to consumers for personal use. We are not responsible for business losses, loss of business, loss of profit or loss of commercial opportunity.
Nothing here affects your statutory consumer rights.
27. Your responsibilities
To let us coach you safely and well, you agree to:
- give materially accurate information;
- complete health screening honestly;
- tell us about relevant health changes;
- follow reasonable safety instructions;
- use suitable equipment;
- avoid deliberately doing things you have been advised not to;
- get professional medical advice when reasonably necessary; and
- ask us if you are unsure about an exercise, a programme or a recommendation.
We are not responsible for consequences caused by materially inaccurate or deliberately withheld information that we reasonably relied on, except to the extent the law provides otherwise.
28. Suspension or ending by us
We may suspend or end your membership if you:
- repeatedly fail to make required payments;
- seriously breach these Terms;
- share paid content or your account credentials;
- abuse or threaten the Coach or other Members;
- use the Services unlawfully; or
- give deliberately misleading information that materially affects our ability to provide the Services safely.
Where a breach can reasonably be corrected we will normally give you a chance to correct it first.
We may also end coaching where we reasonably consider continuing would be unsafe or outside our professional scope.
If we stop providing a Service for reasons unrelated to your breach, we will deal fairly with any unused prepaid amount and make any refund the law requires.
29. Deleting your account
You can ask us to delete your account and everything held about you at any time, by emailing hello@mindfulmovementclub.com.
We will do it, and the Privacy Notice (section 16) sets out precisely what is removed and the two things that necessarily remain for a short period. Where the law requires us to keep an accounting record of a payment, we keep the minimum needed for that alone.

Please give us enough detail to understand and investigate. Making a complaint does not restrict your statutory consumer rights.
If you are unhappy with how we have used your personal information, you can also complain to the Information Commissioner's Office — see the Privacy Notice, section 19.
31. Events outside our control
We are not responsible for a delay or failure caused by circumstances outside our reasonable control. If such an event materially prevents us providing paid Services, we will take reasonable steps to limit the effect and will keep affected Members informed. Your statutory rights are unaffected.
32. Transferring this agreement
You may not transfer your membership to anyone else without our written agreement.
We may transfer our rights or obligations to another business as part of a legitimate restructuring, sale or service arrangement, provided that doing so does not reduce your legal rights.
33. If part of these Terms is invalid
Each provision operates separately. If a court finds one unlawful or unenforceable, the rest continue to apply so far as legally possible.
34. Delay in enforcing these Terms
If we do not immediately enforce a provision, that does not mean we have given up the right to enforce it later.
35. Changes to these Terms
We may update these Terms where reasonably necessary — because of changes to the law, our Services, payment arrangements, technology or how the business operates.
Material changes affecting an existing paid membership will be communicated in advance where appropriate. We will not use a change to these Terms to remove your statutory rights.
36. Governing law
These Terms are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom, you may also benefit from mandatory consumer protections applying where you live, and nothing here prevents you bringing proceedings in a court available to you under applicable consumer law.
37. The whole agreement
These Terms, together with:
- the membership or programme description;
- your order confirmation;
- our Privacy Notice and Cookie Policy;
- any specific programme conditions shown before purchase; and
- any separate consent you give,
form the agreement relating to your use of the Services.
If there is an inconsistency, specific terms expressly shown to you for your particular membership before you buy take precedence over these general Terms, to the extent of that inconsistency.
